We are keeping a close eye on the case involving an 18-year-old who was allegedly on drugs when he fatally killed a man in a head-on freeway accident.

A judge this week ruled that Timothy Theodore Barnette must stand trial on charges of gross vehicular manslaughter while intoxicated and DUI causing injury, a judge ruled Wednesday.

The deadly crash happened in May, when Barnette’s Land Rover struck a car being driven by 22-year-old Nick Hart on the freeway in Rancho Penasquitos.

Witnesses reported seeing Barnette driving his vehicle erratically and at high speed just prior to the accident.

Monster Energy Drink is in the news with the mother of a teenager who died from cardiac arrhythmia last year blaming his death on the popular energy drink. A Monster Energy Drink lawsuit filed earlier this month alleges the teen’s heart condition and subsequent death was caused by habitually drinking the beverage.

19-year-old Alex Morris went into cardiac arrest July 1, 2012… and was taken to the hospital where he later died.

The lawsuit filed in Northern California’s Alameda County alleges Morris would not have died if he did not drink two cans of Monster Energy Drink a day for three years.

Meanwhile, a similar situation is unfolding in Georgia where a mother claims Monster caffeine levels are responsible for her child’s chest pains.

“My eldest daughter started to complain of chest pains about six months ago,” Elizabeth says to LawyersandSettlements.com. “I mentioned it to my friend and she said I had better ban all those energy drinks. Right away I looked online – ohmigod, I couldn’t believe it. I might as well have given my kids a beer or a cigarette!

An elderly couple was struck and killed by a suspected drunk driver Sunday north of Valley Center.

Police say the driver, 20-year-old Earl Smith Jr., was driving on Old Castle Road near Mauka Driver early Sunday morning when his car drifted right into the elderly pedestrians. Authorities say the couple – a 79-year-old man and a 78-year-old woman – had been walking with their backs to traffic at the time. Both died at the scene.

Another San Diego dog bite attack investigation is underway. Police are investigating the fatal shooting of a pit bull by a homeowner in the Valencia Park section of San Diego.

Police say the dog was shot Monday night in the 5800 block of Duluth Avenue.  The pit bull allegedly attacked a man and his husky while they were outside. According to police, the dog attack prompted the man to into his house and get a gun. The man then attack the pit bull with the butt of the gun, but when the dog would not retreat – he opened fire, killing it.

According to authorities, Harold Oliver Wise IV of Lakeside lost control of his Nissan and veered into oncoming lanes, where the sedan collided with a Jeep Wrangler. Police say the Nissan was traveling at least 80 mph at the time.
