    We Played Hardball with the
    Insurance Company and won

    In this case, the at-fault driver was uninsured. We pursued an uninsured motorist claim against our client’s insurance company.

    At first, our client’s insurance company paid only $87,000 which wasn’t enough so we filed a demand for arbitration, threatened insurance bad faith, and litigated this case until they paid the entire policy limits of $500,000 plus med pay of $100,000.

    During the litigation, the defense hired two physicians
    to opine our client’s injuries were not caused by the crash. They were wrong. But because the insurance company paid the $100,000 med-pay under the policy,
    we threatened bad faith because the insurance policy
    said they would only pay if the injuries were caused
    by the accident.

    Consequently, the insurance company realized it was cornered and was potentially committing bad faith,
    so after three years of pushing and litigation, they folded and paid the entire policy limits like they should have
    on day one.

    StaxUp’s Argument Didn’t Stack Up

    The case was a premises liability case with disputed liability against StaxUp Storage and Strat Property Management, Inc.

    Our client was a 35 year old man who was in a 5X5 storage unit at StaxUp Storage and stood on a plastic tote box to stack up a cardboard box. As he was stepping down, he lost his balance and used his right hand to brace himself on a 6’11 inch door header that was made of exposed sheet metal. He sliced three of his fingers on his right dominant hand and sustained permanent nerve injuries to the pads of his fingertips.

    Defendants argued it was not foreseeable that anyone would be injured given the height of the doorframe. We argued it was foreseeable given the vertical nature of the business and StaxUp Storage’s website which encouraged customers to stack up their belongings to the ceiling.

    The jury awarded $280,000, but found our client to be 25% comparatively at fault which reduced the verdict to $210,000. Because we were the prevailing party, we recovered an additional $60,996.11 in costs bringing the total recovery to $270,996.
